1. The Service
Homeland Security SA (Pty) Ltd (registration 2021/951307/07, PSIRA 4404022) (“Homeland”) offers a footage review service in terms of which, on receipt of a valid request and payment of the prescribed fee, Homeland will review recorded footage from cameras on its network for the time window and location specified in the request.
2. No Guarantee of Footage
Confirmation of camera coverage means only that Homeland operates or has access to cameras in the general vicinity of the specified location. It is not a representation or warranty that the incident was captured, that any recording is of usable quality, that vehicles, registration plates or persons are identifiable, or that footage will assist the requester in any claim or proceeding. Camera angle, obstructions, lighting, weather, distance and equipment condition all affect what is recorded.
3. Fees & Payment
The fee is calculated at R500.00 excluding VAT (R575.00 including VAT at 15%) per hour, or part thereof, of the review window specified by the requester, subject to a minimum charge of one (1) hour. Part-hours are rounded up to the next full hour. By way of example, a review window from 14:00 to 16:00 is two (2) hours and is charged at R1 000.00 excluding VAT (R1 150.00 including VAT); a window from 14:00 to 16:30 is rounded up to three (3) hours.
The fee is charged per review window and covers the review of all relevant cameras across that window. Where the requester later expands the review window, or where the window supplied proves inaccurate and a wider window must be reviewed, the additional hours will be quoted and invoiced separately and no work will be undertaken on those additional hours until payment is received.
The fee is only invoiced after Homeland confirms coverage. Invoices are issued via Xero to the email address provided and are payable within twelve (12) hours of issue. If payment does not reflect within this window, the request lapses automatically and Homeland is under no obligation to preserve or review any footage. Homeland accepts no liability for footage overwritten before payment is received or before a request is submitted.
4. No Refunds
The fee is charged for the review service itself — the operator time and resources required to search and review recordings — and not for the delivery of any particular footage or outcome. The fee is strictly non-refundable once the review has commenced, including where no footage of the incident is found, where footage is of poor quality, or where footage cannot lawfully be released to the requester.
5. What Is Supplied
Homeland supplies only the portion of footage which, in its reasonable opinion, is relevant to the reported incident. The relevant footage may be very short. Depending on what the cameras captured, the requester may receive only a few seconds of footage, or a clip of a minute or two, and in some cases nothing at all. A vehicle or person passing a camera may be in frame for a matter of seconds.
The fee is charged for the operator time spent reviewing the specified window, and bears no relationship to the length, quality or usefulness of any clip ultimately supplied. No refund or reduction of the fee will be made on the basis that the footage supplied is short, is of limited use, or does not show what the requester hoped it would show. Homeland does not supply raw or continuous footage for the whole review window, and is not obliged to supply footage of any minimum duration.
Footage is ordinarily supplied by secure download link in a standard video format. Homeland retains sole discretion as to format and method of delivery.
6. Footage Retention
Recordings are retained on a rolling basis for approximately seven (7) days, after which they are automatically and permanently overwritten. Homeland has no obligation to preserve footage in the absence of a submitted request, confirmed coverage and payment received in full within the payment window.
Once payment reflects, Homeland will use reasonable endeavours to secure a copy of the footage falling within the specified review window so that it is not lost to the ordinary overwrite cycle. This obligation extends only to the window specified by the requester and only to footage which has not already been overwritten at the time payment reflects. Delay by the requester in submitting a request, or in making payment within the twelve (12) hour window, may result in the footage being permanently lost, and Homeland accepts no liability in that event.
7. Release of Footage & POPIA
Footage may contain the personal information of third parties and is processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Homeland may, in its sole discretion: release footage directly to the South African Police Service, the requester’s insurer or attorney rather than to the requester personally; redact or obscure the identities of uninvolved third parties; and decline to release footage where release would in Homeland’s view be unlawful or improper. A valid SAPS case number, together with the name of the station at which the case was opened, is required for all requests without exception, whatever the nature of the incident. Homeland may verify the case number directly with the station named, and may decline the request and retain the fee where the case number cannot be verified, is not valid, or does not correspond to the incident described. Provision of a false case number or false information is a criminal offence and will be reported.
8. Requester’s Warranties
The requester warrants that all information supplied is true, accurate and complete; that they are the person identified in the request or are duly authorised to act on that person’s behalf; and that the footage is sought for a lawful purpose connected to the reported incident.
9. Turnaround
Once the footage window has been secured in terms of clause 6, the review itself is conducted on a best-effort basis, ordinarily within 3–5 business days of payment reflecting. Securing the footage is not dependent on the review being completed, and the ordinary seven (7) day overwrite cycle does not apply to footage already secured. Turnaround timelines are indicative only and do not constitute a term of the agreement.
10. Limitation of Liability
To the maximum extent permitted by law, Homeland shall not be liable for any indirect, special or consequential loss or damage of any nature arising from or in connection with this service, including loss arising from the absence, quality or content of footage. Homeland’s total aggregate liability arising from any request shall in all circumstances be limited to the fee actually paid for that request.
11. General
This service is not an emergency service — in an emergency call 087 238 2900 or 10111. These terms constitute the entire agreement in respect of the service, are governed by the laws of the Republic of South Africa, and prevail over any conflicting terms. Homeland may amend these terms at any time; the version published at the time of submission applies to a request. Nothing in these terms excludes rights which cannot lawfully be excluded under the Consumer Protection Act 68 of 2008.
